When the Supreme Court of the United States speaks, the nation is supposed to listen—especially the president. That’s how the checks and balances of our fragile democracy are designed to work. But this past week, Donald Trump, with the full-throated support of Senator Marco Rubio, looked at the highest court in the land and effectively said: No.
Let’s break down what just happened—because it’s chilling.
Kilmar Armando Abrego García, a legal Maryland resident, was mistakenly deported to El Salvador last month. He was under protection due to credible threats of gang violence, and his removal from the country was not just a bureaucratic blunder—it was a violation of his rights and U.S. law.
On April 10, the U.S. Supreme Court unanimously ruled that his deportation was unlawful. In its decision, the Court ordered the federal government to “facilitate” Abrego García’s return and restore him to the legal position he would’ve held had he not been deported.
But instead of complying, Trump did what Trump does best: defied precedent, decency, and the Constitution. In a joint appearance with Salvadoran President Nayib Bukele, Trump thanked him for “his strength” and said the U.S. would “respect El Salvador’s sovereignty”—a diplomatic euphemism for flipping the bird to the Supreme Court.
Bukele declared he will not return Abrego García to the U.S. Trump and Rubio responded not with outrage or diplomatic pressure, but with approval. They’ve essentially decided that the Supreme Court’s orders are optional—when it suits them.
This is a constitutional crisis. It is not hypothetical. It is not theoretical. It is not future-tense. It is happening right now.
When the Executive Branch refuses to carry out a lawful order from the Judicial Branch, the rule of law collapses. The idea that the courts can serve as a check on authoritarian power? Gone. The notion that U.S. citizens have protections under the Constitution? Hanging by a thread.
If the president can ignore the courts and openly collude with a foreign leader to deny justice to a resident of this country—what can’t he do?
And don’t let the silence fool you. Many in the Republican Party are quietly thrilled. This isn’t just about Kilmar Abrego García anymore. It’s about power—who gets to wield it, and who gets to be crushed beneath it.
We should all be horrified. But horror alone isn’t enough. This moment demands protest, pressure, and a full-throated defense of the very principles that underpin American democracy.
If Trump gets away with this, the Supreme Court might still wear its robes—but it’ll be nothing more than theater. The law only matters if those in power agree to be bound by it.
Right now, they’re not.
